By signing below, you confirm your agreement, understanding and acknowledgment to the following terms and requirements for your participation in the Incognito & Co. Community Engagement Program.

You understand and agree that:

• You will comply with Incognito & Co. Business Conduct Guidelines:

  • Incognito & Co. strives to maintain a healthy, safe and productive environment free from discrimination and harassment, whether based on race, color, religion, gender, gender identity or expression, sexual orientation, national origin, genetics, disability, age or any other factors that are unrelated to Incognito & Co.’s legitimate organization interests. Incognito & Co. will not tolerate sexual advances or comments, racial or religious slurs or jokes, or any other conduct, such as bullying, that creates or encourages an offensive, hostile, or intimidating atmosphere. Other prohibited conduct includes threats or violent behavior. The use, distribution, sale or possession of illegal drugs or any other controlled substance, except for approved medical purposes is prohibited. 

  • Do not give the appearance of speaking or acting on Incognito & Co.’s behalf – only authorized individuals may do so. When you speak out in a public forum or on social media, you must make it clear that you do so as an individual, unless authorized. Never make misleading or dishonest statements or engage in activities that could be considered unethical, fraudulent or otherwise unlawful. 

  • Incognito & Co.’s proprietary information and intellectual property are Incognito & Co.’s assets. Some proprietary information is confidential and such information can be subject to copyright, patent, trademark, trade secret, other intellectual property or legal rights. You may not share Incognito & Co.’s confidential information with, or accept confidential information from, another party unless it has been approved by Incognito & Co. and the participating party. Be sure to obtain approval before creating a social handle using Incognito & Co.’s name, proprietary information or intellectual property.

• You will comply with all applicable laws.

• You are volunteering and/or donating freely, in your personal capacity and participation is not required of you. Volunteering is the contribution of time and/or skills to a not-for-profit organization or school for the advancement, assistance, or enrichment of the community

• You do not expect and will not receive any reciprocal benefit for any volunteer work or donation.

• You will not present yourself as an agent or representative of Incognito & Co. and you will not make any commitments, nor represent that you can make commitments for Incognito & Co. You are deemed as an individual for any volunteer work you perform.

• You will not use any Incognito & Co. proprietary materials nor any Incognito & Co. owned assets (except Incognito & Co. Community Engagement Program resources) in connection with your work as a volunteer.

• You consent to the provision of your personal data hereunder and agree that your data shall be used to administer the program and personalize your experience. You understand and agree that your data will be aggregated to help Incognito & Co. to improve the organization and assess participation.

• You consent and agree that photographs and/or video recordings may be taken of you during your volunteer activities. You grant Incognito & Co. the royalty free and perpetual right and license to use, copy, display, publish, edit, distribute and develop any content derived from the photographs or video recordings of you and to use your name and other information about you in any format and any medium of distribution or publication, either alone or accompanied by other material, for the purpose of creating Incognito & Co. material and promoting Incognito & Co. and its volunteer programs (internal or public) including in print, on the internet and social networks (such as but not limited to Twitter, LinkedIn, Facebook, YouTube, or Instagram).

• You agree that Incognito & Co. may reproduce, shorten, extract, combine or develop any or all of the photographs or video recordings. You agree that Incognito & Co. shall retain all rights, when used as a part of other Incognito & Co. materials. When a photo or video is taken, you agree that you will not have any right to review, inspect or approve the photos or videos, and additionally waive any and all claims or liabilities relating in any way to their use. If you do not wish to have your photo or video taken, it is your responsibility to inform any photographer, videographer or to inform the coordinator of activities in writing in advance.

• You agree that taking unauthorized photographs or videos of any Incognito & Co. representatives, volunteers, participants, guests, or minors is prohibited. 

• You will not be covered by any Incognito & Co. insurance as Incognito & Co. is not responsible for any volunteers, participants, or third-party entities.

• You undertake any activity described in this agreement at your own risk. Incognito & Co. will not be responsible for your actions and will not give you an indemnity in connection with your volunteer work or donation.

• Finally, you agree and acknowledge that Incognito & Co. has the right, at any time and in its sole discretion, to change the terms of this agreement and modify or terminate any related program. You also acknowledge and agree that Incognito & Co. also reserves the right, in its sole discretion, to decide who may participate in the Incognito & Co. Community Engagement Program and to terminate any volunteer's eligibility to participate in the Incognito & Co. Community Engagement Program.
